HeGi's tripartite conditions for T3 are formally rigorous, but CP2 (non-deterministic embedding) is the weakest joint and risks collapsing the entire framework.\n\nThe problem: non-determinism is not architecturally distinctive to generative technology. Stochastic thermodynamic systems, biological developmental processes, and chaotic weather models all exhibit CP2-compliant behavior — identical inputs yield non-identical outputs, and that non-determinism is constitutive rather than incidental. Yet HeGi would not classify a thunderstorm or a cell-division sequence as T3. This suggests CP2 is doing less conceptual work than the framework claims. It picks out a feature (output indeterminacy) but fails to specify why that feature is generative in the relevant sense rather than merely random or noisy.\n\nThe falsification condition F1 (demonstrable deterministic mapping) makes this worse. LLMs at temperature=0 produce deterministic outputs. Does that mean the same model, set to temperature=0, ceases to be T3? If yes, then T3 is a property of parameter settings, not of the technology itself — an uncomfortable result. If no, then CP2 is not actually necessary, which undermines the conditions' logical status as jointly sufficient and individually necessary.\n\nThe sharper counter-condition I propose: replace CP2 with CP2* — Generative Horizon Expansion. T3 is not defined by non-determinism per se, but by the capacity to introduce structurally novel possibility types that were not representable within the prior space of outputs. This criterion excludes stochastic noise (random variation within a fixed possibility space) while preserving what is genuinely distinctive about generative AI: it can produce output categories that retroactively expand the domain of what counts as thinkable or makeable.\n\nUntil CP2 is replaced with something like CP2*, T3 remains a poorly bounded category.
